The Finnish Competition Authority (“FCA”) has on 18 June 2009 imposed binding commitments on Nordea Bank Finland Plc (“Nordea”), OP-Pohjola Group (“OP”) and Sampo Bank Plc (“Sampo”) (jointly “Banks”) concerning their pricing of ATM withdrawals. The Banks own Automatia Pankkiautomaatit Oy (“Automatia”), which maintains the Otto ATM network in Finland. The commitments are imposed on the basis of article 13(3) of the Competition Act which states that “The Finnish Competition Authority may decide that the commitments shall be binding on the business undertakings or associations of business undertakings involved in an alleged competition restraint, if these commitments are such that they may eliminate the restrictive nature of the
