I. Introduction In its decision of 26 June 2009, the Dutch competition authority (Nederlandse Mededingingsautoriteit, « NMa ») assessed a complaint brought by the Dutch Federation of Agriculture and Horticulture (Land- en Tuinbouw Organisatie, « LTO ») and Glaskracht Nederland (« Glaskracht ») against the pricing policy of GasTerra B.V. (« GasTerra »). GasTerra is a Dutch company active in the trade and supply of natural gas worldwide. LTO and Glaskracht are agricultural interest groups whose members are users of natural gas. LTO and Glaskracht alleged that GasTerra charges excessive prices for natural gas. They also claimed that GasTerra discriminates by charging higher tariffs for small-scale users than for large-scale users and different prices for Dutch and non-Dutch users. II.
