The Bulgarian Supreme Administrative Court affirms the Competition Authority’s decision to prosecute a water supply operator for abuse of dominant position (Sofiyska Voda)

On 17 June 2009 the Supreme Administrative Court of Bulgaria [1] reviewed the decision of the Bulgarian Competition Authority (CPC) [2] that prosecuted Sofiyska Voda (SV) [3] , a water supply operator in Bulgarian capital of Sofia for abuse of dominant position. The facts of the case were as follows. Until 2000 all residential buildings in Sofia had common meters for consumption of water supplied by SV. In 2000 SV took a decision that all of its customers should conclude individual contracts for water supply and install individual meters. For those buildings that continued to use common meters SV allocated the payments for the consumption among residents ex officio. As some residents were late in paying their
