The Bulgarian Supreme Administrative Court confirms the Competition Authority’s decision to fine a heating plant company for exploitative abuse of dominance (Heating Plant Ruse)

On 18 June 2009 the Supreme Administrative Court of Bulgaria [1] upheld the decision of the Bulgarian Competition Authority (CPC) [2] , which prosecuted Heating Plant in the municipality of Ruse (HPR) [3] for abuse of its dominant position on the market for production and distribution of thermal heating in Ruse. The dispute originated from a complaint lodged by Mr. Stoyanov, who was representing residents of the newly constructed building in the Ruse municipality. When owners of the new apartments approached HPR in order to connect to its heating network they were offered a contract that contained a clause requiring all property owners in a building to conclude a lien contract with the HPR to secure the payment for the heating consumed
