The Czech Regional Court in Brno cancels the decision of the President of the Office for the Protection of Competition concerning a well-known, long-running international cartel operating within the sector of gas insulated switchgears on the grounds of breaching the legal principle of ne bis in idem (GIS cartel)

I. Introduction On 26 June 2008, the Regional Court in Brno cancelled the decision of the President of the Czech Office for the Protection of Competition (the „Office«) concerning a well-known, long-running international cartel operating within the sector of gas insulated switchgears («GIS»). Although the decision of the President of the Office dated 26 April 2006 [1] reduced the fines which were imposed by the first instance decision of the Office upon 16 international engineering companies, it still remains to be the highest fine ever imposed in the history of the Office. II. Summary of the proceedings The Office rendered its first instance decision on 9 February 2007 [2] whereby such companies were fined for their cartel conduct consisting of coordinating price bids in tenders for
