The Hungarian Court of Appeal upholds the NCA’s decision against the "road construction cartel" (Egút Egri Útépítõ / Strabag Építõ / Hídépítõ)

With its judgment of second instance adopted on 11 June 2008, the Metropolitan Court of Appeal has upheld the judgment of first instance and therefore the decision of the Hungarian Competition Authority in the lawsuit brought by Egút Egri Útépítõ Zrt, Strabag Építõ Zrt and Hídépítõ Zrt as plaintiffs against the Hungarian Competition Authority as defendant and established that the plaintiffs violated the cartel provisions of the Hungarian Competition Act. 1. Background The Hungarian Competition Council adopted a decision in 2004 establishing that the plaintiffs made anti-competitive bids in the offering phase of a public procurement tender in relation to road construction works at inner Bartók Bela Street and the rebuilding of Bocskai junction with respect to the construction of underground line 4
