The Polish Competition Authority conditionally clears a merger referred back from the EC Commission in the large retail distribution sector while imposing supermarkets divestments (Carrefour Nederland/Ahold Polska)

On 28 June 2007, the President of the Polish Office for Competition and Consumer Protection (the “President of the OPCC”) issued a merger control decision, providing conditional clearance for the intended acquisition of 100% of the shares in Ahold Polska Sp. z o.o. (“Ahold”) by Carrefour Nederland B.V. (“Carrefour”). Background Carrefour and Ahold, both operating on the worldwide retail market for daily consumer goods, signed a sales and purchase agreement whereby Carrefour would acquire ownership of Ahold's 183 Albert supermarkets, 15 Hypernova mini-markets and four petrol stations.
