Background reminder The EU Regulatory Framework in the telecommunication sector (framework resulting from the European Telecommunication Package, namely the Framework Directive 2002/21 [1] and its accompanying directives and communications) imposes on national regulatory authorities (NRAs) that they carry out full market analysis in the communication sector in order to determine if and to what extent it may be necessary to impose ex ante obligations on operators with “Significant Market Powers” (“SMP”) in order to contribute to the development of “effective competition in the telecommunication sector during the transition from monopoly to full competition”.
