The Munich Higher Regional Court decides that the prohibition to resell products on internet auction platforms is exempted under the Vertical Block Exemption Regulation (Amer Sports)

On 2 July 2009, the Higher Regional Court of Munich confirmed a judgement of the Regional Court of Munich. The question at stake was whether the defendant was allowed to prohibit the sale of its products via internet auction platforms through its general terms and conditions. Facts The plaintiff is a central office for the prevention of unfair competition (Wettbewerbszentrale).
