A German Court accepts prohibition of selling through auction websites (Amer)

In a recently published judgment of 2 July 2009, the Higher Regional Court of Munich (the “Court”) found that a manufacturer of sports products (Amer) was allowed to prohibit its distributors to resell its products through auction websites, such as eBay. Amer had been sued by the German Association against Unfair Competition before the Munich courts, claiming that Amer‘s prohibition on direct or indirect resale through auction websites was unlawful.
