The Swiss Competition Commission adopts a new communication on vertical agreements

[1] I. Introduction 1. On July 2nd, 2007, the Swiss Competition Commission (the “ComCo”) adopted a revised communication on the assessment of vertical agreements (the “Revised Communication on Vertical Agreements” or “Revised Communication”), which replaces the previous communication of February 18th, 2002 [2]. It is inspired by Commission Regulation 2790/1999 of December 22, 1999 [3] (“Regulation n° 2790/1999” or the “Block Exemption”) and by the European Commission's Guidelines on the assessment of vertical restraints (the “Guidelines on Vertical Restraints”). The Revised Communication will not be binding upon Swiss courts but will have a considerable impact on the ComCo's future practice. 3.
