The Slovenian Competition Authority finds, after full judicial review overturning its original decision, local public utility company did not abuse its dominant position in the local market for cemetery and funeral services (JKP Log)

This case started in December 2003, when company Primozic complained to the Slovenian Competition Authority (“SCA”) about the abusive practices of public utility company JKP Log in the market for cemetery and funeral services in three counties in eastern Slovenia. The SCA started the proceeding on the basis of article 10 of the Slovenian Prevention of the Restriction of Competition Act (“SPRCA”) concerning abuse of dominance. The proceedings were introduced for the purposes of assessing the alleged JKP Log's discriminatory practices in regard unjustifiably refusing acceptance of desist people transported to cemeteries by company Primozic, while not refusing desist people transported to cemeteries by some other funeral companies, also registered for conducting of funeral services.
