Background This interlocutory judgment sets the scene for a review by the English courts of the European case-law relating to refusals to supply and essential facilities as well as a possible future reference to the European Court of Justice. It concerns the British Horseracing Board (BHB), the governing authority for British horseracing, which operates a database of information on horseracing in Great Britain. This includes pre-race data such as the place and date of race meetings, the distance involved, the owner and trainer of each horse, a list of runners and riders, etc. Until 29 March 2004, Attheraces Ltd (ATR) had a media rights agreement with BHB giving ATR exclusive rights of access to 49 of the 59 British racecourses, and another agreement giving it rights to BHB's
