The Paris Court of Appeal orders obligations imposed on a retailer by the Competition Authority to be suspended until it has ruled on the retailer’s appeal against the Authority’s infringement decision (STIHL)

On 23 January 2019, the Paris Court of Appeal ordered the suspension of the obligations imposed by the French Competition Authority on STIHL in its decision of 24 October 2018 (the “Decision”). This order requiring the suspension (the “Order”) is to remain in effect until the Court rules on the merits of the appeal filed by STIHL against the finding of an infringement in the Decision. By its Decision, the French Competition Authority (“FCA”) fined STIHL, a German manufacturer of outdoor power tools, € 7 million
