The EU General Court grants interim measures to a company fined by the Commission raising the issue whether late payment interest should be suspended (Garantovana)

To better understand the purpose of this article, a distinction is made between the following parameters : Commission Decision adopted on 22 July 2009 (the "Decision") [1], order of the President of the General Court on the request for interim measures (the "order") [2] & the subsequent judgment of the General Court – "GC" (the "judgment") [3], the appeal introduced against the above judgment before the Court of Justice of the European Union ("CJEU") (the "appeal") [4] and the recent action for annulment against the letter of the Commission dated 21.12.2012 (the "new action" before the GC) [5]. In order to get straight to the point, we will not go into all the facts and legal aspects of each file and action but rather will limit the discussion to the topic at hand. Relevant facts
