The Polish Competition Authority fines cable TV operator for providing incorrect information in merger control proceedings (UPC / Aster)

On January 30, 2012, the Chairperson of the Polish Office for Competition and Consumer Protection (the UOKiK) issued a decision in a case relating to the provision of incorrect information by UPC Polska sp. z o.o. (UPC) in merger control proceedings concerning the acquisition of Aster sp. z o.o. (Aster) – one of UPC's major competitors in the pay-tv market in Poland (decision No. DKK-6/2012). The UOKiK fined UPC a remarkable PLN 775,000 (i.e. ca. EUR 175,466) for the failure to provide the authority with the Commercial Due Diligence report prepared by Solon Management Consulting for Aster (the Solon report), which related in part to competitive conditions on the market.
