The Local Court of Bonn rules that no access is granted to the documents voluntarily submitted by a leniency applicant (Pfleiderer)

The Local Court in Bonn (Amtsgericht) decided on 18 January 2012 that no access will be granted to documents voluntarily submitted by a leniency applicant. According to the Local Court the threat to the effective detection and prosecution of competition law infringements justified in the present case to refuse access to the leniency application. Access will only be granted to the exhibits restrained by the German Federal Cartel Office («FCO«), after having blackened the business secrets of the companies and information on the internal procedures of the FCO. The decision of the Local Court cannot be appealed.
