The Swiss Competition Act undergoes extensive analysis after five years in force

The Swiss Competition Act of 2003 requires an evaluation of the law after five years in force. An expert report published in December 2008 on the subject [1] suggests further adapting Swiss competition law to European legislation in various areas, namely by abandoning per-se unlawfulness of certain vertical agreements or improving the functioning of the Swiss competition authorities. After an extensive survey among interested groups, associations and experts which lead to substantial responses of all kinds, a committee of competition law experts has published a summary report containing recommendations for improvement.
