The Cypriot Commission for the Protection of Competition rejects a complaint on predatory pricing under Section 6 of the Cypriot law for the protection of competition (Akis Ioannou / A. Ioannou Medicare / Forum Optical / Opthalmos Laser Centre / Aktis)

On the 29th of January 2009, the Cypriot Commission for the Protection of Competition (hereinafter: the “Commission”) rejected the complaint brought before it by Akis Ioannou, A. Ioannou Medicare Ltd., Forum Optical Ltd. and Opthalmos Laser Centre Ltd. (hereinafter: the “complainants”) against Aktis Ltd. regarding the alleged product disparagement and predatory pricing by the latter in the market for the supply of laser machines used for refractive eye surgery. Facts of the case In May 2005, Akis Ioannou (importer of ophthalmic products through his company, A. Ioannou Medicare Ltd., and owner of the retailer of optical products, Forum Optical Ltd.) imported from Germany into Cyprus the laser machine Allegro 400, which was equipped with new technology for refractive eye surgery.
