The Polish competition authority grants merger clearance to a company close to attaining a dominant position in the national beer market (Kompania Piwowarska / Browar Belgia)

This article discusses the OCCP's decision approving a merger between Kompania Piwowarska [1] and Browar Belgia [2] (decision n° DKK - 5/08). The merger is the fourth of its kind in the industry within the last five years and the second where Kompania Piwowarska is an acquiring company. It is an interesting case for three reasons. Firstly, after this merger Kompania Piwowarska‘s market share will have approached 40%, the threshold from which the dominant position is presumed. Secondly, the merger will strengthen Kompania Piwowarska‘s position as a market leader. And thirdly, it may induce further consolidation of the beer sector.
