The Turkish Competition Authority holds that a distribution agreement between a chips producer and distributors contains prohibited resale price maintenance (Frito Lay)

By a decision dated 11 January 2007, the Turkish Competition Board (Hereafter “CB”) held that the international chips producer Frito Lay's hand terminal system is prohibiting the distributors from determining the resale prices and therefore can not be considered in the scope of the Block Exemption Regarding Vertical Agreements Communiqué n° 2002/2 (Hereafter “Communiqué n° 2002/2”) The international company Frito Lay specializes in the distribution of chips and other various appetizers. Its distribution network is organized throughout regional distributors.
