Introduction On 31 January 2007 the French Supreme Administrative Court (Conseil d'État) handed down a judgement annulling a merger authorisation in the press sector. This decision is worthy of comment as it is rare that the Conseil d'État annuls Ministers' authorisations [1]. This article aims to present the Court's decision and considers questions raised by it. Indeed, the mere existence of a decision should, in itself, be welcomed as an indication that the French Administrative Supreme Court is exercising a real and extensive control over Ministry Decisions which may well diffuse some of the criticism
