The Indian Government enacts the comprehensive Information Technology Rules providing governance structures for social media and related companies

Introduction The Indian Government in February, 2021 enacted the comprehensive Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“Media Code”) providing governance structures for social media and related companies. It encompasses an embargo of compliances upon online websites, apps and portals of social media networks, digital news platforms, OTT/OCCP platforms and other such functionally similar intermediaries. These compliances are in nature of due diligence requirements, mandatory oversight and grievance redressal mechanism and user verification.
