The Indian Competition Authority directs a company to file a merger notification following several minority stakes acquisitions (Piramal)

Introduction The Competition Commission of India (“CCI”) directed Piramal Enterprises Limited (“Piramal”) to file a notice pursuant to Section 20(1) of the Competition Act, 2002 (“Act”), read with Regulation 8 of the Competition Commission of India (Procedure in regard to transaction of business relating to combinations) Regulations, 2011 (“Combination Regulations”), according to which, if an enterprise fails to file a notification with the CCI, the CCI upon its own knowledge or information received, inquires into the anti-competitive effects of the transaction and has the power to direct the parties to file a notification under Form II [1] of the Combination Regulations.
