An Italian Administrative Court clarifies the boundaries of third parties’ right to access the file in antitrust matters (Alitalia)

With its judgment of February 2, 2012, the Tribunale Amministrativo del Lazio (i.e. the lower Italian administrative Court which adjudicates appeals against decisions issued by the Autorità Garante della Concorrenza e del Mercato, «IAA«) clarified the boundaries of third parties' right to access the file in antitrust matters. The Court held that plaintiffs willing to make use of the evidence acquired by the IAA in the context of public enforcement proceedings, so as to support follow-on actions for damages before civil courts, are not vested with an unqualified right to obtain copies of the documents on file, as their interest
