BACKGROUND The Paris Court of Appeals (hereafter “the Court”) confirms a decision by the French Competition Council (hereafter “the Council”) which fined SNCF and Expedia, Inc. (hereafter “Expedia”) in a decision No. 09-D-06 of 5 February 2009. The appeal was brought by Karavel (a travel agency, plaintiff before the Council) and Expedia. SNCF and Lastminute joined their appeals. The Council had fined SNCF for several abuses of dominant position and for prohibited vertical agreements with Expedia, using SNCF's legal monopoly for railway transport of passengers on the national railway network to favor a joint subsidiary created with Expedia (Voyages-sncf.com agency).
