The Czech Supreme Administrative Court takes a liberal approach towards information exchange agreements (Building savings banks)

On 25 February 2009, the Supreme Administrative Court rejected cassation appeal of the Czech Office for Protection of Competition (the “Office”) against the judgment of the Regional Court in Brno which struck down Office's decision imposing fines on six building savings banks for allegedly entering into illegal information exchange agreement on the Czech market for building savings in 1997-2004. The Supreme Administrative Court confirmed more liberal approach of the Regional Court towards information exchange agreements. Summary of the Proceedings On 19 December 2006, the Office imposed fines ranging from approx. CZK 4 million to CZK 20.5 million on six major building savings banks in the Czech Republic. The Office found that those savings banks entered into information exchange
