The Romanian Constitutional Court confirms the constitutionality of provisions relating to the investigative and decision-making powers of the Competition Authority (Astral Impex / Gabi’s / BDM)

Summary Addressing the challenge of constitutionality of certain provisions of the Competition Law regulating the investigative and decision-making powers of the Competition Council, the Romanian Constitutional Court adhered to its preceding jurisprudence and dismissed the applicants' allegations regarding infringement of the constitutionally guaranteed right for fair trial and principles of the judicial organization in Romania. The case was decided on the basis of the administrative nature of the proceedings before the Competition Council that cannot be equalized with the administration of justice carried out by the courts.
