PresentationContext of the claim 1. On 12 February 2008, the French Competition Council (hereafter the “Council”) has rejected Free's claim for interim measures regarding the conditions of access to civil engineering facilities of France Télécom (hereafter “FT”), in the context of the development of optical fiber services (FTTx). Nonetheless, the Council has decided to carry on its inquiry regarding France Télécom's practices in this area. 2. Free claimed that, with regards to the deployment of fiber networks for the purpose of offering very high speed Internet services, France Télécom's civil engineering infrastructures (“ducts”) represented an essential facility. This would imply that France Télécom should grant access to this facility under fair, transparent and non discriminatory conditions,
