I. Background In a decision of 5 February 2007, the Swiss Competition Commission ("Comco") held that Swisscom Mobile enjoys a dominant position on the market of termination of calls on its mobile phone network and abused its dominant position by applying an excessively high termination rate of CHF 33.5 centimes per minute, to the detriment of consumers, until 31 May 2005. Therewith, the Comco closed its investigation of the Swiss mobile phone market for the period up to 31 May 2005. For this violation of the Competition Act, the Comco imposed a fine of 333'365'685 Swiss Francs on Swisscom Mobile.
