The German Bundeskartellamt fines the leading drugstore chain for selling below purchase price (Rossmann)

[1] On 6 February 2007 the German Federal Cartel Office announced that it had imposed an administrative fine in the amount of EUR 300,000 on Rossmann, the leading German drugstore chain, for alleged sales below the purchase price. The decision is based on section 20 (4) of the German Act Against Restraints of Competition (ARC) (Gesetz gegen Wettbewerbsbeschränkungen, GWB). It prohibits enterprises with a dominant or superior market position from selling goods below the purchase price “more often than occasionally”, unless objectively justifiable grounds exist for doing so.
