On 21 February 1991, the Court issued a preliminary ruling confirming that national courts may suspend the enforcement of national administrative measures implementing Community [EU] regulations and setting out uniform conditions under which national courts may adopt such interim measures. The preliminary question was referred to the Court by the Finanzgericht (Finance Court) Hamburg in the context of proceedings between Zuckerfabrik Süderdithmarschen, a sugar producer, and the Hauptzollamt (Principal Customs Office) Itzehoe in which the applicant appealed a decision adopted on the basis of Council Regulation (EEC) No 1914/87 of 2 July 1987 introducing a special elimination levy in the sugar sector for the 1986/87 marketing year.
