The Czech Supreme Administrative Court allows belated ex post review of dawn raid’s legality (Delta pekarny / Bakeries cartel)

On 21 December 2017, the Supreme Administrative court rejected cassation appeals of both the Czech Office for Protection of Competition (“Office”) and all three claimants (participants to bakeries cartel), namely companies Delta Pekarny, OK Rest, and Penam against the previous judgment of the Regional Court in Brno which rejected claims against the Office previous decision finding an infringement of competition rules by bakeries cartel but it also cancelled another (later) decision of the Office due to ne bis in idem principle. The Supreme Administrative Court ruled that the Regional Court was correct to undertake an ex post review of former dawn raids conducted in the proceedings before the Office despite that more than 12 years passed since the dawn raids and rejected also other
