The Polish Competition Authority fines undertakings for setting minimum resale prices on ski equipment and accessories (Fordex / Intersport)

I. The Decision In its decision no DOK-1/2016 of 23rd December 2016, the Office of Competition and Consumer Protection (hereinafter the “Polish Competition Authority”) imposed a fine on Fordex and Intersport for violating Article 6 (the equivalent of Article 101(1) of the Treaty) of the Act on Competition and Consumer Protection of February 16, 2007, Journal of Laws of 2015, item 184 (hereinafter the “Polish Competition Act”). The violation involved ski equipment and accessories made by Nordica. Fordex (ski equipment wholesaler, sole distributor of Nordica) and Intersport (store network, one of the retailers) violated the Polish Competition Act by agreeing on minimum resale price of Nordica products across Intersport stores.
