The Polish Competition Authority fines ski equipment wholesaler for vertical pricing restraints (Fordex)

In its decision in Case DOK-1/2016 of 23 December 2016, the President of the Office of Competition and Consumer Protection (the “OCCP”) imposed a fine of PLN 72,345 (approx. EUR 16,500) on a ski equipment wholesaler Przedsiębiorstwo Produkcyjno-Handlowe Fordex sp. z o.o. (“Fordex”), for fixing the minimum retail reselling prices for skiing equipment and accessories with one of its retail distributors, INTERSPORT Polska S.A. (“Intersport”). Fordex is the sole distributor in Poland of ski equipment and accessories made by Nordica, and Intersport is one of the retailers.
