The Polish Competition Authority fines gas boilers and water heaters producer for vertical price fixing (Termet)

In its decision of 19 December 2016, the Polish Competition Authority (Prezes Urzędu Ochrony Konkurencji i Konsumentów, hereinafter referred to as the “OCCP President” or the “PCA”) fined Termet S.A. the amount of PLN 212,919.00 (approximately EUR 49,000.00) for imposing fixed resale prices (Resale Price Maintenance, ‘RPM’) on its distributors. Proceedings in this case began with the information acquired during a market investigation carried out by the PCA. Termet is a manufacturer of gas boilers and water heaters, and sales its products through the following distributors: Autometal, SBS, MAR-ROM1, EUROTERM and TGS Technika Grzewcza i Sanitarna. Termet concluded an agreement with each distributor under which the distributor was obliged to make much effort in relation to its pricing policy.
