The Polish administration adopts a new legal framework on counteracting the unfair use of contractual advantage
I. Introductory Remarks
The act on counteracting the unfair use of contractual advantage in the trade in agricultural and food products of December 15, 2016, Journal of Laws of 2017, item 67 (hereinafter: the “Act”) will enter into force on 12 July 2017. It is the result of EU-wide discussions on how best to address the unfair business-to-business practices in the commercial relations between retail chains and suppliers. Many of the issues raised in the 2013 Green Paper of the European Commission on unfair trading practices in the business-to-business food and non-food supply chain in Europe (COM/2013/037) resulted in adopting national regulation all across Europe.
