The Polish competition authority strikes down bid-rigging practices in the agricultural sector (APA)

In its decision of 31 December 2013 , the Polish competition authority (Urząd Ochrony Konkurencji i Konsumentów, the "UOKiK") reviewed a bid-rigging case involving three farmers who participated in a tender organised by the Agricultural Property Agency ("APA") to sell undeveloped agricultural property. The agency is tasked with the restructuring and privatisation of state-owned agricultural property through sales and leases to individual farmers, including by means of restricted tender procedures. According to the decision, when APA was auctioning an agricultural property in the city of Unislaw, three farmers jointly agreed right before the auction that only one of them would make an offer and the other two would give up bidding.
