The Czech Supreme Administrative Court deals with succession of liability for competition law offences (Sokolovska uhelna)

On 30 December 2013, the Supreme Administrative Court cancelled the judgment of Regional Court in Brno (as well as the preceding decision of the Chairman of the Czech Office for protection of competition) in the case regarding anticompetitive export prohibitions included in agreements between a mining company Sokolovska uhelna and its purchasers of brown coal (lignite). The Regional Court in Brno previously confirmed the decision of the Office for Protection of Competition (“Office”) which imposed a fine of approx. CZK 17 million on Sokolovska uhelna for concurrent violations of Article 81 EC (now 101 TFEU) and Section 3(1) of the Czech Competition Act (in multiple versions applicable throughout the duration of the infringement) that were committed by entering into and performing
