The Chinese Bureau of Price Supervision and Anti-monopoly of NDRC initiates antitrust investigation case against telecom operators based on Art 17, 18 & 19 AML (China Telecom and China Unicom)

I. Introduction 1. On November 9, 2011, “News 30min” of China Central Television(CCTV) disclosed Bureau of Price Supervision and Anti-monopoly of National Development and Reform Commission (NDRC) initiated an antitrust case against China Telecom and China Unicom, to investigate whether these two companies abused the market dominant position in the field of broadband access in order to hinder and affect other operator’s entry into the relevant market and violate China’s Anti-monopoly Law (AML) [1]. With regard to CCTV news on “Telecom and Unicom is under antitrust investigation”, People’s Posts and Telecommunications News under Ministry of Industry and Information Technology of the People’s Republic of China (MIIT) issued the paper and thought that: “the opinion on Telecom and Unicom monopoly
