The Italian Antitrust Authority fines national postal incumbent for abuse of dominant position (Post / Poste Italiane)

Following the complains of TNT Post Italia S.p.A. (TNT), on 15/10/2009 the Italian Antitrust Authority (Autorità Garante della Concorrenza e del Mercato - AGCM) started a preliminary investigation to assess a potential violation of the article 102 TFUE by Poste Italiane S.p.A (PI). After the first European directive about postal services (97/67/CE), in 1998 PI became a public listed company, yet all the shares are owned by the Italian Ministry of Economy. On the other hand, TNT is a public company operating worldwide that is principally owned by the Scottish Widows pension fund. In the 2007 TNT was the first company to launch a new postal service called “Formula Certa” which guaranteed the delivery at a given date and time offering the possibility of checking every step of the delivery
