The European Commission adopts revised competition rules on horizontal co-operation agreements

The European Commission has revised its rules for the assessment of co- operation agreements between competitors, so called horizontal co-operation agreements. The new rules consist of two updated Block Exemption Regulations covering R&D and specialisation / joint production agreements and a set of guidelines (the “Guidelines”) covering these and other common forms of horizontal co-operation. The main changes that have been introduced are a substantial review of the standardisation chapter, introducing more transparency into the process of standard-setting, and a new chapter on information exchange which attempts to explain exactly when an exchange of information is good or bad for competition. In particular, this new chapter provides clarity on the treatment of information
