Summary The German Federal Cartel Office (FCO) settled a number of proceedings against German gas suppliers for the alleged abuse of a dominant position under sections 19 and 29 of the Act Against Restraints of Competition (ARC) (gas price procedures). Until December 2008 the FCO had accepted commitments from energy suppliers in 29 cases of 33 pending proceedings offering compensation to consumers worth 127 million Euros. Background The (flawed) liberalisation of German energy markets has led, contrary to expectations, to persistent competition problems. To address the issue of permanently high energy retail prices, the ARC was amended in 2007 and section 29 introduced. This contentious provision expires in 2012 as it is hoped that competition will finally unfold in the energy
