The UK Competition Authority publishes revised leniency guidance for businesses and individuals that come forward with information about their involvement in a cartel

Introduction In December 2008, the UK Office of Fair Trading (“OFT”) published revised guidance (“the Guidance”) for undertakings and individuals that are contemplating applying for leniency in cartel cases [1] , which sets out the OFT's position on a number of important leniency-related issues. Seeking confidential guidance from the OFT prior to making a leniency application Undertakings or individuals thinking about applying for leniency may, before doing so, approach the OFT for confidential guidanceon any aspect of the OFT's leniency programme. Such discussions will usually take place on a no-names basis and will be based on a given hypothetical factual matrix with a view to the undertaking or individual obtaining comfort on an issue before deciding whether to make a leniency
