The Spanish Competition Authority fines collecting societies for the second time in two years for abuse of dominance in their management of intellectual property rights (Fonogramas)

On 9th December 2008, the Spanish Competition Commission (“CNC”) issued a decision, establishing that the Association for the Management of Intellectual Property Rights (AGEDI) and the Management Society of Artists, Interpreters or Performers (AIE) had abused their dominant position in the market for the management of intellectual property rights for works of music of authors, performers and producers by imposing unfair and discriminatory trading conditions. The CNC found that AGEDI and AIE had discriminated against several TV Channels : Sogecable SA (“Sogecable”), Canal Satélite Digital SL (“CSD”) and Distribuidora de Televisión Digital SA (“DTS”) in negotiating higher rates for copyrighted material with them than with the public channel Radio Televisión Española (“RTVE”) between the years
