The Dutch Competition Authority clears a joint venture for the rollout and management of an optical fiber network subject to behavioural remedies (Reggefiber)

Introduction On 19 December 2008 the Dutch Competition Authority (Nederlandse Mededingingsautoriteit, hereafter the NMa) authorized a joint venture (JV) by KPN and Reggefiber conditional upon behavioural remedies [1] . The imposed remedies address the focal points of OPTA's most recent Market Analysis Decision (at the time), aiming to take away both vertical and horizontal effects that could potentially be caused by the JV. KPN, as the leading telecommunications in the Netherlands, owns the Dutch copper-line network, while Reggefiber is the owner of most Dutch optical fiber to the home (FttH) projects. The notified JV will install FttH networks, providing unbundled access to third-party providers which will allow them to offer combinations of fixed telephony, television and internet
