The Croatian Constitutional Court affirms the constitutionality of certain provisions of the Competition Act and its application in conformity with the EU standards (P.Z.A.)

Summary The Croatian Constitutional Court rejected the challenge against AZTN's decision prosecuting the exclusive importer of the Volkswagen automobiles in Croatia for abuse of dominant position in accordance with the EU standards applied to this type of violation of competition law. The Court clarified that even in the absence of the legal obligation to apply the EU standards the AZTN proceeded correctly in using the specified standards as supplementary legal interpretation tools that contributed to the consistent application of national competition law in the absence of the national standards.
