The Belgian Prosecutor refuses to prohibit grant of a public tender for public bicycle rental system (ClearChannel Belgium/JC Decaux Belgium sa and Région de Bruxelles-Capitale)

In Spring 2008, the government of the Brussels-Capital Region (Région de Bruxelles-Capitale/ Brussels Hoofdstedelijk Gewest) issued an invitation to tender for the creation and implementation of an automatic bicycle-hire system for public use in the Brussels region. Three tenders were submitted and the government awarded the contract to JC Decaux on 5 December 2008. The two unsuccessful bidders immediately lodged formal objections to this decision. The invitation to tender had specified that tenders which did not require any financial intervention by the regional government would be preferred. The regional government encouraged such offers by offering the successful bidder the right to sell advertising space to help finance the system. All three tenders took advantage of this offer.
