The Slovenian Competition Authority, acting for the first time under art. 82 EC, fines 130 000 EUR an abuse of dominant position in the packaging waste processing market (Slopak)

This case started in December 2005, when packaging waste processing service provider Intersoh complained to the Slovenian Competition Authority (“SCA”) about the abusive practices of its rival Slopak in the market for processing packaging waste, which is not communal waste. The SCA started the proceeding on the basis of article 10 of the Slovenian Prevention of the Restriction of Competition Act (“SPRCA”) concerning abuse of dominance and for the first time in the SCA's existence also on the basis of provisions of Article 82 of the EC Treaty. The proceedings were introduced for the purposes of assessing the alleged infringements in regard preventing service users to use competing service providers and in regard spill-over of funds between different services of handling of packaging waste.
