The Czech NCA applies Art. 81 EC to a distribution network based on direct sales to consumer (Tupperware)

The present decision concerns the compliance of the dealership contracts concluded between Tupperware s.r.o and independent dealers with Article 81 of the EC Treaty and similar national provisions contained in the Act on the Protection of Competition (hereafter the “Act”). Tupperware s.r.o. is a manufacturer of plastic kitchen utensils, which it sells throughout the EEA. It has its own distribution network operating on the basis of direct sales in customer's homes. This sales method not only allows the customer sufficient time to get acquainted with Tupperware's products in an intimate home environment but it also provides an opportunity to make new social contacts. These characteristics make it considerably different from alternative sales methods employed by other distribution
